What Happens to a Loved One's Car When They Die in Malaysia

A car is often one of the most visible and immediately practical assets to deal with after a loss. It is sitting in the driveway, it may still have an outstanding loan, and someone needs to figure out what to do with it — often before the estate administration process is anywhere near complete.

Here is a plain English guide to what happens and what needs to be done.

The car is part of the estate

When someone dies, their car becomes part of their estate — like their bank accounts, property and other assets. This means it cannot simply be taken over, sold or transferred by a family member without going through the proper legal process.

JPJ requires that the person requesting the transfer has the legal right to do so, confirmed through estate-related documents such as a Grant of Probate, Letter of Administration, Small Estate Distribution Order or an Amanah Raya distribution instruction. motorist

Until that legal authority is in place, the car remains registered in the deceased's name.

What to do in the meantime

While the estate administration process is underway, there are a few practical things to address.

Insurance

Until the ownership transfer is completed, heirs can renew the car insurance under the deceased owner's name for temporary coverage. The policy will still be issued under the deceased's name — this is a temporary measure to ensure the vehicle remains legally covered. bjak

Road tax

Road tax cannot be renewed online for a deceased owner's vehicle. It must be renewed physically at a JPJ counter or Pos Malaysia, and can only be renewed for a maximum of six months at a time for the first three years after the owner's death. bjak

Keep the insurance and road tax current while the estate is being administered — driving an uninsured or untaxed vehicle creates additional complications.

If there is an outstanding car loan

If the car is still under financing, the loan must be handled before ownership can be transferred. The finance company may still have a claim over the vehicle, which means the estate or authorised person may need to settle the outstanding balance or obtain the necessary clearance from the bank. motorist

Contact the bank or finance company as soon as possible to notify them of the death and understand what steps are required. Do not simply continue making monthly payments under the deceased's name without notifying the lender.

If your loved one had a hire purchase insurance policy attached to the loan — similar to MRTA for home loans — it may settle the outstanding balance upon death. Check with the lender whether such a policy exists.

How to transfer the car to a family member

Once the estate administration is complete and the relevant legal documents have been obtained, the process of transferring the car to a beneficiary follows these steps:

Step 1 — Obtain the legal authority

Obtain either a Grant of Probate, a Letter of Administration, a Declaration or Order by Amanah Raya Berhad, or a Court Order to begin the process of changing the ownership title. The rightful heir will receive the relevant documents during the estate distribution process. bjak

Step 2 — PUSPAKOM inspection

Bring the vehicle to PUSPAKOM along with the Vehicle Ownership Grant or Vehicle Ownership Certificate (VOC) for a Transfer of Ownership Inspection (B5 Inspection). Once the inspection is complete, you will be given a B5 Report, which must be presented along with other documents to JPJ. bjak

Step 3 — Renew insurance under the new owner's name

After the PUSPAKOM inspection, renew the vehicle insurance in the new owner's name before visiting JPJ. Notify the insurance agent about the transfer of ownership prior to renewal. bjak

Step 4 — Gather documents for JPJ

Prepare the JPJ K3A form and TM-3 Checklist along with the following documents:

  • Death certificate
  • MyKad of the successor or administrator
  • Vehicle Ownership Grant or VOC
  • Grant of Probate, Letter of Administration, Small Estate Distribution Order or Amanah Raya distribution instruction
  • PUSPAKOM B5 Transfer of Ownership Inspection Report bjak
  • Step 5 — Visit JPJ

Submit all documents at the nearest JPJ branch to complete the ownership transfer. This must be done in person.

Step 6 — Renew road tax

Once the ownership transfer is complete, renew the road tax under the new owner's name.

If you want to sell the car

The process for selling the car is similar to transferring it to a family member — the estate administration must be completed and the legal authority obtained before the car can be sold to a third party. Families should avoid waiting until the last minute, especially if the car has been unused for some time, because issues such as expired insurance, expired road tax, battery problems, tyre condition or missing documents may slow down the process. motorist

Once the legal authority is in place, the sale follows the standard used car process — PUSPAKOM inspection, insurance in the new owner's name, JPJ transfer and settlement of any outstanding loan.

    A few practical tips

Keep the car insured and road-taxed while the estate is being settled. An uninsured or untaxed vehicle is a liability. Renew temporarily under the deceased's name if needed.

Find the Vehicle Ownership Certificate (VOC) early. This is the original document proving ownership and is required for the PUSPAKOM inspection and JPJ transfer. If you have trouble finding it, you can request a replacement at any JPJ branch for a small fee. says

Check for hire purchase insurance. If the car had an outstanding loan, check whether an insurance policy was attached that settles the balance upon death. This can significantly simplify the process.

Don't drive the car without sorting out insurance. Until the ownership is formally transferred, make sure any family member driving the vehicle is covered under the existing policy or a new temporary one.

    Frequently Asked Questions

Can a family member drive the car before the ownership is transferred?

Yes, provided the vehicle has valid insurance and road tax. However, the car remains legally registered in the deceased's name until the transfer is complete, so it is worth checking with the insurer that coverage extends to other drivers in the meantime.

Do I need a lawyer to transfer the car?

Not necessarily. If the estate qualifies for the small estate route through the Land Office or Amanah Raya, you may be able to handle the process without legal representation. For estates going through the High Court, a lawyer will typically be involved in the broader estate administration, which includes the car transfer.

What if the car has no outstanding loan and is low in value?

The process is the same regardless of the car's value — JPJ still requires the legal estate documents before transferring ownership. There is no simplified process for low-value vehicles.

What if I can't find the Vehicle Ownership Certificate?

Apply for a replacement at any JPJ branch. Bring the death certificate and your own MyKad. There will be a small fee for the replacement.

How long does the whole process take?

The JPJ transfer itself can be completed in a single visit once all documents are in order. The bottleneck is usually the estate administration process that needs to happen first — which can take months depending on the route taken.
